If Applicant is OUTSIDE the US:
Once ISSS receives a complete E-3 Application in DestinyOne, we will begin the Labor Condition Application (LCA) process with the US Department of Labor (DOL). The process takes a minimum of 7 days.
After the DOL certifies the LCA, ISSS will email a copy of the Certified Labor Condition Application (LCA) to the applicant abroad. The E-3 Applicant will need to schedule a visa appointment with a US Embassy/Consulate abroad. Note that there are significant wait times at some US Embassies. Applicant may not enter the US more than 10 days prior to the start date listed on the LCA.
This process may take anywhere from 2 weeks to a few months from the date USCIS receives a complete E-3 application, depending on how soon the applicant can receive an E-3 visa stamp from a US Embassy and enter the US in E-3 status.
If the E-3 Applicant is already in the US:
Once ISSS receives a complete E-3 Application in DestinyOne, we will begin the Labor Condition Application (LCA) process. The process takes a minimum of 7 days.
After the Department of Labor (DOL) certifies the LCA, ISSS will compile an E-3 Petition and submit it to the US Citizenship and Immigration Services (USCIS). The E-3 Applicant can begin working at Temple as of the start date listed in the E-3 Petition and our office has received the ORIGINAL Approval Notice from USCIS.
If Department Submits a check for $2500 for E-3 Premium Processing, we would expect a response from USCIS (approval, RFE, NOID) in 15 days or less from the date USCIS receives our petition. ISSS must have received the original E-3 Approval Notice from USCIS before E-3 can begin employment at Temple.
Extending E-3 Status
Department will need to submit a complete E-3 Application through DestinyOne. ISSS will need to submit an LCA to the Department of Labor. Once the LCA is certified by DOL, either the E-3 employee will need to travel outside the US apply for a new E-3 Visa Stamp or ISSS will need to submit an E-3 Petition to USCIS. Provided USCIS receives the Extension Petition prior to the employee's current E-3’s I-94 Expiration Date, the employee may work for 240 days beyond the current I-94 expiration date.
Amendment H-1B Petition
The employee may not begin working in a new position until USCIS receives our E-3 Amendment petition. Contact HR/Payroll Management for more information once the E-3 petition is submitted.
Transfer E-3 Petition
E-3 status does not have “Portability”. This means that an E-3 employee may not begin working with Temple University until USCIS approves our E-3 petition or E-3 travels outside the US and reenters with Temple’s LCA. Contact ISSS for further information as Premium Processing may be necessary.
